New York State provides different titles for the many judges handling divorce and Family Court cases. In Supreme Court, you will appear before a Justice on your case. Sometimes, the Supreme Court Justice will have a Special Referee try part of your case if no settlement is made. Supreme Court is the only court that can grant you a Judgment of Separation, Annulment or Divorce. In Family Court, there are Judges, Referees and Magistrates. The Referees take care of the overflow from the Judges and try to have your case taken care of more quickly since the Referee's calendar is usually much smaller than a Judge's calendar. The Support Magistrates can only hear paternity, child support and spousal support cases. In addition, if paternity is contested, the case will then be transferred to a Family Court judge.
